Arbitration can be a binding or non-binding process, depending on the terms of the agreement.

Arbitration offers several potential benefits, including a potentially faster and more cost-effective process compared to traditional litigation. It also provides more flexibility and confidentiality. Gard Law Firm, LLC has handled numerous arbitration matters. Benefit From Gard Law Firm Arbitration Experience in Boulder, CO

At Gard Law Firm, our attorneys consult with their clients to understand the dispute and discuss the advantages and disadvantages of arbitration as opposed to litigation. If both parties agree to arbitration, they sign an arbitration agreement outlining the terms and conditions of the process. We assist our clients in selecting an arbitrator or participate in the selection process.

Just like in traditional litigation, arbitration involves the preparation and submission of pleadings, evidence, and legal arguments. We represent our clients by drafting and filing necessary documents. Discovery in arbitration can be more streamlined than in litigation, but it still involves the exchange of relevant information, documents, and evidence. We help gather and present evidence to support our client’s position.

Our attorneys engage in pre-hearing activities, which may include witness preparation, document review, legal research, filing motions and strategy development. We present our client’s case at the arbitration hearing, including introducing evidence, questioning witnesses, making legal arguments, and advocating for our client’s desired outcome. After the arbitration hearing, we may submit post-hearing briefs, summaries, or other documents to reinforce our client’s position. If the arbitration results in an award, we can also help our clients enforce or challenge the award, depending on the outcome.

A petition requesting that the record be sealed must be filed in the District Court, in the county where the records are located. All of the agencies who maintain the record must be provided with notice and an opportunity to object to the petition to seal.

If the petition to seal is granted by the Judge you would not be obligated to disclose any information contained in the sealed records to any employer, educational institution, state or local government agency, officials, and employees in any application or interview. Further, if an interviewer or application inquires about any criminal records that may have been sealed you may legally claim that no such action ever occurred and that no such record exists.

Moreover, upon any inquiry, all criminal justice agencies are required to state that no such records exist. With certain limited exceptions, once the record is sealed, the documents legally could be examined only if you or the prosecuting attorney petitions the Judge and the Judge grants the examination. However, please be advised that the arresting agency is permitted to share information contained in a sealed record when an inquiry is made by another criminal justice agency.

If you are not eligible to seal your arrest and criminal record for any of the reasons above, we have developed a method to help you explain your legal situation. We find that by being honest about your criminal history, combined with emphasizing all that you did to complete your sentence and any “life lessons” you learned in the process, can help you obtain and advance in your employment, education or other endeavors. Honesty is the best policy and you can help a prospective employer understand your side of the story. This approach has helped many people convince the employer to take a chance.
