Benefit From Gard Law Firm Record Sealing Experience

At Gard Law Firm, we offer consultations to individuals who are interested in sealing their criminal records. We assess the individual’s eligibility and explain the process, requirements, and potential benefits. Our attorneys review the individual’s criminal history and the specific laws in their jurisdiction to determine whether they meet the eligibility criteria for record sealing. Eligibility factors may include the type of offense, the outcome of the case, the passage of time since the offense, and the individual’s criminal record.

Our attorneys assist clients in gathering the necessary documents and information to support the record sealing petition. This may include court records, arrest records, sentencing documents, and other relevant paperwork. We prepare and file the record sealing petition with the appropriate court. The petition outlines the reasons for seeking record sealing and provides legal arguments in support of the request. We represent our clients in court hearings related to the record sealing process. We present arguments to the judge, respond to any objections, and advocate for our clients’ interests.

Finally we notify relevant parties, such as law enforcement agencies or prosecutors, about the petition to seal records. We ensure that our clients comply with any additional requirements set by the court, such as completing rehabilitation programs or community service, as a condition for record sealing. Criminal Record Sealing in Boulder, CO | FAQs

Criminal record sealing, also called expungement, involves restricting access to your criminal records, making them generally inaccessible to the public.

Eligibility for record sealing varies depending on the nature of the conviction, sentence completion, and the passage of time. Misdemeanor and petty offense convictions are generally easier to seal than felony convictions.

The duration of the sealing process can vary. It often depends on the complexity of your case, the court’s caseload, and other factors. On average, it may take a few months from the filing of the petition to the final decision.

While sealed records are generally inaccessible to the public, they are visible to law enforcement agencies and certain government entities.

Under certain circumstances, sealed records may be unsealed by court order. However, this is typically rare and requires a compelling reason, such as a subsequent criminal offense. Typically, this is done only at the request of the person whose record is sealed.

A petition requesting that the record be sealed must be filed in the District Court, in the county where the records are located. All of the agencies who maintain the record must be provided with notice and an opportunity to object to the petition to seal.

If the petition to seal is granted by the Judge you would not be obligated to disclose any information contained in the sealed records to any employer, educational institution, state or local government agency, officials, and employees in any application or interview. Further, if an interviewer or application inquires about any criminal records that may have been sealed you may legally claim that no such action ever occurred and that no such record exists.

Moreover, upon any inquiry, all criminal justice agencies are required to state that no such records exist. With certain limited exceptions, once the record is sealed, the documents legally could be examined only if you or the prosecuting attorney petitions the Judge and the Judge grants the examination. However, please be advised that the arresting agency is permitted to share information contained in a sealed record when an inquiry is made by another criminal justice agency.

If you are not eligible to seal your arrest and criminal record for any of the reasons above, we have developed a method to help you explain your legal situation. We find that by being honest about your criminal history, combined with emphasizing all that you did to complete your sentence and any “life lessons” you learned in the process, can help you obtain and advance in your employment, education or other endeavors. Honesty is the best policy and you can help a prospective employer understand your side of the story. This approach has helped many people convince the employer to take a chance.
