Benefit From Gard Law Firm Criminal Trial Experience

At Gard Law Firm, we consult with our clients to understand the details of the case, explain the charges and potential consequences, and discuss possible defense strategies. We conduct thorough investigations to gather evidence, interview witnesses, review police reports, and examine forensic data to build a strong defense strategy. Our attorneys file pre-trial motions to address legal issues or seek rulings that may impact the course of the trial. These motions can cover matters such as evidence suppression, dismissal of charges, or requests for a change of venue. We participate in the process of selecting jurors for the trial, aiming to choose a fair and impartial jury that will decide the case based on the evidence presented.

Gard Law Firm’s attorneys make opening statements at the beginning of the trial, outlining the key points of the case and providing a preview of the evidence they plan to present. We question witnesses during direct examination and cross-examination to elicit relevant information and challenge the opposing side’s case. We present evidence, including physical evidence, documents, and testimonies, to support our client’s defense and challenge the prosecution’s case. Our attorneys make legal arguments throughout the trial, such as objections to evidence, arguments regarding the admissibility of certain testimony, and interpretations of relevant laws.

In addition, we may also call upon expert witnesses, such as forensic experts, medical professionals, or specialists, to provide testimony on complex or technical aspects of the case.

Finally, we deliver closing arguments, summarizing the evidence, highlighting key points, and making persuasive arguments to the jury in favor of their client’s innocence or a favorable verdict. We participate in discussions about jury instructions, which are the legal guidelines provided to the jury to help them deliberate and reach a verdict. After the jury reaches a verdict, our criminal trial attorneys may be involved in post-trial motions and hearings, as well as sentencing proceedings if their client is convicted.

A petition requesting that the record be sealed must be filed in the District Court, in the county where the records are located. All of the agencies who maintain the record must be provided with notice and an opportunity to object to the petition to seal.

If the petition to seal is granted by the Judge you would not be obligated to disclose any information contained in the sealed records to any employer, educational institution, state or local government agency, officials, and employees in any application or interview. Further, if an interviewer or application inquires about any criminal records that may have been sealed you may legally claim that no such action ever occurred and that no such record exists.

Moreover, upon any inquiry, all criminal justice agencies are required to state that no such records exist. With certain limited exceptions, once the record is sealed, the documents legally could be examined only if you or the prosecuting attorney petitions the Judge and the Judge grants the examination. However, please be advised that the arresting agency is permitted to share information contained in a sealed record when an inquiry is made by another criminal justice agency.

If you are not eligible to seal your arrest and criminal record for any of the reasons above, we have developed a method to help you explain your legal situation. We find that by being honest about your criminal history, combined with emphasizing all that you did to complete your sentence and any “life lessons” you learned in the process, can help you obtain and advance in your employment, education or other endeavors. Honesty is the best policy and you can help a prospective employer understand your side of the story. This approach has helped many people convince the employer to take a chance.
